Taxi drivers are self-employed independent contractors. They do not have medical, vacation, sick leave, retirement plan, etc. Medallion waiting list was created for those that choose to have a career as taxi drivers. The extra income generated by getting a taxicab medallion would help them to pay their bills at old age; when they are not able to push themselves and work as much. This was the implied contract of the San Francisco Government.
So far, under SFMTA, 184 Taxicab Medallions has been sold with more under way. In Prop K restructuring, SFMTA agreed that for every sold medallions, they would issue one to the top of the Waiting List. If what SFMTA did was not sale than nothing has ever been sold. These medallions did not go to the top of the waiting list. Let us examine the financial impact:
Because senior drivers, now, under SFMTA, are selling their Medallions
(for disability reasons, etc.) the rate of return/year to top of the medallion waiting list is not going to be even 5 Medallion/year. Years ago, under TAXI COMMISSION, the rate could go as high as 10 Medallions/year to top of the Medallion waiting list. Using this older estimate:
184 / 10 = 18.4 years people on the list could move up the list (and not down).
If we say, medallions skipped 50% of those on the waiting list. Then we have:
2,897 people on the waiting list (list as of Sept. 20, 2011). So 2897 / 2 = 1,448.5
Say the difference between having a medallion and not having one is $20,000/year. (Though companies like for a less valuable RAMP Medallion are paying close to $27,000 and smaller companies are paying around $36,000/year).
The financial impact to half of those on the waiting list is:
$20,000 x (1,448.5 = #of people on top half of the list) x (18.4 = years, because around 50% were pushed down) = $533,048,000
This is the low-end estimate. The high-end estimate is:
$36,000 x (1,448.5 = #of people on top half of the list) x (2 = with 5 medallions to top of the list, the list would move twice as slow x18.4 = years, because around 50% were pushed down) = $1,918,972,800
As of February 23, 2012, based on my information, around 210 Medallions were sold. Making the matter worth for those on the Waiting List, SFMTA wants to keep the newly issued medallions and medallions from dead and disabled to themselves for future renting (around $2,500/month). They want to keep around 500 medallions for this purpose. If the list was moving about 5/year, this way it would come to near halt. Again, as I understand it, this is breach of contract by San Francisco Government (which SFMTA represent).

1. THIS MEANS YOU WOULD NOT BE ABLE TO OPERATE YOUR OWN BUSINESS (BUY YOUR CAR, GET YOUR INSURANCE, GET YOUR DRIVER, PAY FOR A COLOR SCHEME). YOU WOULD HAVE TO GIVE YOUR MEDALLION TO A CAB COMPANY AND YOU BECOME A GAS-AND-GATE DRIVER. YOU WOULD BE GETTING SOME MONTHLY CHECK FROM A CAB COMPANY BUT BECAUSE YOU WOULD NOT HAVE THE NEGOTIATION POWER, THEY COULD GIVE YOU SMALLER CHECK IN THE FUTURE AND HAVE A HIGHER GATE FEE.
2. SFMTA WANTS 1/3 OF THE MEDALLIONS TO THEMSELVES (NOT TO THE WAITING LIST). DURING “TAXI COMMISSION”, NEWLY ISSUED MEDALLIONS AND MEDALLIONS FROM DEAD OR DISQUALIFED WOULD GO TO THE TOP OF THE WAITING LIST. SFMTA WANTS THESE MEDALLIONS. MANY WOULD HAVE TO WAIT 500 YEARS TO GET A MEDALLION.
THIS WAS NOT THE CONTRACT (IMPLIED CONTRACT) OF THE GOVERNMENT TO CAB DRIVERS. CAB DRIVERS AVERAGE $35,000/YEAR WITH NO BENEFITS WHILE MUNI AVERAGES $85,000 WITH FILL BENEFITS. MUNI ORGANIZED AND GOT IT WE MUST ORGANIZE TOO. JUST MAKING NOISES AND DEMONSTRATING IS NOT ENOUGH. WE MUST HAVE OUR OWN LAWYER FOR MARCH 6th MEETING BY SFMTA BECAUSE THEY DO. ON SUNDAY FEBRUARY 26TH , 3PM WE NEED THOUSANDS TO MEET AT PIER 48. IF WE DO NOT SPEND SOME MONEY NOW WE COULD END UP LOSING THOUSANDS OF DOLLARS EVERY YEAR. EVERYONE SHOULD TELL TEN FRIENDS, GET THEIR NAME AND CELL PHONE, AND ASK THEM TO DO THE SAME. HOPE FOR THE BEST BUT BE READY FOR THE WORST.
URGENT
It is widely believed that … was behind the implementation process of “Back-Seat-Terminal,” “GPS based Electronic Waybill” and company based credit/debit card processing. Now, it is believed that he is for ELIMINATION OF AFFILIATES. This means that all medallion holders, which run their own business (buying the cab, doing maintenance, getting drivers, insurance, etc.), must give up their medallions to cab companies, in exchange for say $2,500/month. Because the control would be out of drivers’ hand, in the future, that might become $2,000/month, or even less. They, and all other drivers, would become GAS-AND-GATE drivers ONLY; paying the company’s gate fee.

Why SFMTA would wants to give you all the medallions and control of all the drivers? Is it possible that, to divide the taxi industry, first SFMTA promises you what you want to hear? If this is the case then, when SFMTA defeated the taxi drivers and medallion holders, you would be in a weaker position to challenge further advances by SFMTA.
We do not have to bring the example of big government and excessive control of ex-Soviet Union, or the Red China. We already know that if those social models were workable, they would not collapse and they would not turn to free enterprise and smaller government control. We can, and should, look at the management model of SFMTA. Is there a need to say that they are sucking our money into their failed system? With more control in the hand of SFMTA, and less control in the hand of cab companies, medallion holders and cab drivers I believe that we would turn into another failed enterprise.
What can we do? On February 26th, 3PM we need thousands to meet at PIER 48. We must have enough money to hire a legal representation for March 6th meeting by SFMTA. Joining forces is necessary. Sitting on the sideline and letting others to sweat would make us all loose. We cannot succeed with limited participation. Everyone should tell TEN friends, get their name and cell phone, and ask them to do the same. We need thousands because this is a DO OR DIE.
Saam Aryan, once again you are only concerned about an issue that only involves you. Saam you started a group called cabbies helping cabbies and you have done nothing for most of the cab drivers. I for one applaud the SFMTA for taking over some of the medallions, now maybe we can be assured that there will be a legitimate interest in the industry and to start bringing in important things like driver safety nets that are long overdue. Something that currently does not occur to often in the taxi industry because of greed! I personally would like it if the SFMTA would take all the medallions and regulate the industry in a more legal way. Including the electronic waybills so the drivers will have to pay their taxes and stop cheating the government. I am not making a claim that all taxi drivers don't pay their taxes so do not get your panties in a wad folks.

It is with our abilities that we can achieve great things. In addition, we are not so static. We grow and we learn. I told you before, before acting, it is better to do some research and gather some facts. You would be discrediting yourself by stating things that are not factual. 1. I believe you tried to stain Mr. Dan Hinds, president of National Cab Company. I found him polite, forgiving, knowledgeable, and respectable. When I worked many years ago for the old man (which owned national cab), they would not even allow drivers to use the bathroom there. They would say take it outside.
2. I did offer you a full time driving job, which you said you would not do.
3. I did try to get you an office job, managing a very good, fast growing, Cab Company; which they said they would not.
4. The disabled lady that teaches RAMP classes was so stressed out that in a few times that she talked to me she was shaking because of you.
5. In video, in front of Supervisors, you said something to this effect: cab drivers should go under GPS-Electronic Waybill…because it is hard for you to write on waybill. This judgment of yours tells me that the 4th Amendment of the Constitution of the United States should be revoked from cab drivers because it is hard for you to write on waybill.
6. You were upset with me. You said: “I helped you but when I needed your help, you did not help.” Dear friend, you, like many others, participated in the protest for your own right, not just mine. Besides, I am not a kingmaker. I am just a cab driver trying to keep cab drivers’ Right alive.
Friend, if you want to challenge me in public, you better back up your accusations with provable facts. While I welcome constructive criticism to better myself, I am going to ignore emotional outburst.

The SFMTA should not be in the cab business. All income that goes to the City from medallions is money that should go to the drivers. The SFMTA is in a dangerous and conspicuous conflict of interest. Its hands should be tied behind its back immediately while we look around for the proper way to proceed.
ReplyDeleteThe people are only served in the short run by this newest MTA effort. The bills might be paid for a short time, but when the bills mount again, there will be no more medallions to commandeer. Even if the City takes all of our earned medallions away from us drivers, the eventuality will come that medallions will not be there for the City to sell, and some other scheme will have to be devised to protect the wealthy and prey upon the populace.
I say to you, SFMTA, why not do the right thing now? Why not find the solution through taxation and realistic prices?
But this question is rhetorical, because you are already in conflict of interest, so you are already known to be on the side of the 1%, against the 99%.
You SFMTA politicians, and the City representatives, are either too cowardly to tax the wealthy, or you are simply working for the wealthy when you devise short-term and very corrupt schemes of paying for government services by taking money away from cab drivers, workers who have a hard time of it to ever make it into the middle class, and no reliable chance to ever retire.
Mr. Clark's remark that Mr. Aryan is merely concerned about an issue that only concerns him is pretty ridiculous. As he has demonstrated by his remarks and with the figures he marshals, Mr. Aryan is a thoughtful and respectable worker concerned about the effects of the onrushing corruption at City Hall and the SFMTA on very many other drivers than himself.
To Mr. Aryan's additional remarks I observe that he either does not know or does not care that Ron Paul is literally and not metaphorically an anarchist. His affiliation with Libertarians makes this clear; the anarchists changed their name to Libertarian about twenty years ago. Of course the media will not tell you this; you have to get your information from more reliable sources, as I have. The libertarian gambit is not acceptable, since proper anarchists are supposed to have answers to such questions as how government is going to happen. Such "Cadillac Anarchists" are not worthy of your support, Sam. They are masquerading as right-wing, but only because they are not really the leftists they sound to be. They are just another rich man's club who does the politics of reducing their own taxation.
Lastly Sam I marvel that you have a kind word for Dan Hinds, who is no friend of yours or any driver's. Again, I believe you are correct in your assessment of the problem that is proposed to be created, but you are not scrutinizing closely enough the persons who are causing the problem.
Please remember that Dan Hinds (together with Carl Macmurdo) is directly responsible for the filibuster that led to the pro-Medallion Sales vote at the Taxi Advisory Counsel, even before the report on the question was prepared and without going through the attendand issues. As I hope you know the Sunshine Ordinance Task Force repudiated the TAC vote, but getting this to mean something is another matter. It doesn't help when you seem to support some of the most driver-unfriendly persons in the history of our industry. Please reconsider some of the further things you have said.

DeleteWhen it comes to policy, as the videos show, I am not on the same page with Mr. Hinds. I did not have the info you mentioned about Ron Paul. I will check it out. Hope you join to get SFMT off our back. They are just testing the water. Their mismanagement will pull us down as well.

ReplyDeleteI just wanted to find out if anybody would mind if i asked cristiane ( Miss H ) for five grande out of the driver fund as Im about to lose my two front lower teeth and my dentist told me thats what it would cost to replace them and that is seemingly the cheapest option. Ive bin driving a cab for twenty five years and the wolves have over taking me and with nothing in the bank, life is getting tougher and i cant put in the hours I used too, all these years I just made enough to get by and now age has caught up with me. As I know you read this Blog Miss H is there any chance you can help me and others in the same boat out. Thank you

DeleteCab drivers who earn anywhere from $25,000 - $35,000 a year are in the very low income bracket by SF standards. I know I couldn't afford the dental work.

Saam, I too am extremely surprised you think so much of Dan Hinds. I did my homework on this one! You make quite a few accusations about me, someone you may have spoke to all of about an hour in your life. Anyway Saam your not worth arguing with. I simply think you whine quite a bit and have crazy thoughts that you tie into things that do not make any sense. Your intentions might be good, I just think you pair up with some of the wrong people that don't give a damn about you or the taxi drivers.
